Terms and Conditions

Effective date: September 12, 2026

Welcome to Claimsurance.com. These Terms and Conditions govern your access to and use of Claimsurance.com and any claim-review reports, information, forms, communications, or related services offered through the website.

By accessing the website, submitting a request, purchasing a service, or providing claim documents, you agree to these Terms and Conditions. If you do not agree, please do not use the website or its services.

1. About Claimsurance

Claimsurance provides independent, informational reviews of property-and-casualty insurance claim materials, including claims in which artificial intelligence, automated systems, or digital decision-making tools may have influenced the handling or outcome.

Claimsurance is independent and is not affiliated with, endorsed by, or acting on behalf of any insurance company, government agency, law firm, public-adjusting firm, technology provider, or claims-management platform unless expressly stated otherwise.

2. Informational Service Only

Claimsurance reports and communications are provided for informational and educational purposes.

Claimsurance does not:

  • Provide legal advice or legal representation
  • Create an attorney-client relationship
  • Act as your insurance company
  • Make claim or coverage decisions for an insurer
  • Guarantee that an insurer will pay, reopen, reconsider, or increase a claim
  • Negotiate or settle an insurance claim on your behalf
  • Represent you before an insurer, regulator, court, or other party
  • Perform public-adjusting services
  • Provide engineering, contracting, accounting, appraisal, or other licensed professional services

A Claimsurance report is an independent assessment based on the information provided. It is not a legal opinion, formal appraisal, engineering report, coverage determination, or substitute for advice from a qualified attorney, licensed public adjuster, engineer, contractor, accountant, or other appropriate professional.

3. No Guarantee of Results

Insurance claims depend on policy language, endorsements, exclusions, deductibles, applicable law, physical evidence, inspection findings, deadlines, and facts that may not be available to Claimsurance.

Claimsurance does not guarantee:

  • That every issue or error will be identified
  • That an insurer used artificial intelligence or automation
  • That a claim was handled improperly
  • That a coverage decision will change
  • That additional insurance benefits will be paid
  • That a report will be accepted by an insurer, attorney, regulator, court, or other party
  • Any particular financial, legal, regulatory, or claim outcome

Statements concerning possible inconsistencies, red flags, coverage questions, or automated decision points are observations for further consideration and are not findings of wrongdoing.

4. Your Responsibilities

You agree to provide information that is accurate, complete, current, and lawfully obtained.

You are responsible for:

  • Reviewing all information before submitting it
  • Providing relevant policy documents, correspondence, estimates, photographs, reports, and other requested materials
  • Informing Claimsurance of important deadlines
  • Continuing to communicate directly with your insurer or representative
  • Preserving original documents and evidence
  • Obtaining professional advice when appropriate
  • Removing unnecessary sensitive information before uploading documents

Do not submit passwords, complete Social Security numbers, complete bank-account numbers, payment-card information, medical records unrelated to the claim, or other information that is not reasonably necessary for the requested review.

You represent that you own, control, or have permission to provide all submitted documents and information.

5. Deadlines and Preservation of Rights

Using Claimsurance does not pause, extend, satisfy, or replace any deadline imposed by an insurance policy, statute, regulation, court, insurer, or other organization.

Claimsurance is not responsible for missed deadlines, including deadlines involving proof-of-loss forms, appeals, lawsuits, regulatory complaints, policy conditions, document requests, or communications with an insurer.

You remain solely responsible for protecting your rights and meeting all applicable deadlines.

6. Scope of Review

The scope of each review will be based on the service description, documents provided, issues identified by the customer, and any written confirmation supplied by Claimsurance.

A standard review may include observations concerning:

  • Policy and coverage language
  • Claim communications
  • Estimates and payment explanations
  • Apparent inconsistencies or missing information
  • Possible automated or AI-assisted decision points
  • Questions that may warrant further investigation
  • Potential subjects to discuss with an insurer or qualified professional

Claimsurance may decline a request, request additional documents, limit the scope of a review, or recommend that the customer consult an attorney or other qualified professional.

7. Technology and Artificial Intelligence

Claimsurance may use software and AI-assisted tools to help organize, compare, summarize, or analyze submitted information.

Technology-generated material may contain mistakes, omissions, or incorrect interpretations. When a paid Claimsurance report is described as human-led, human judgment is used in preparing or reviewing the final report. Nevertheless, no review process can guarantee complete accuracy.

Customers should independently verify important facts, policy provisions, calculations, deadlines, and conclusions before acting on a report.

8. Pricing and Payment

Prices displayed on the website are general estimates and may vary based on the complexity of the claim, the number and condition of the documents, the number of issues presented, and the requested scope of work.

Claimsurance will provide or confirm the final price before paid work begins. Payment may be required before work starts unless otherwise agreed in writing.

Displayed prices may be changed at any time, but a price already confirmed in writing for an accepted assignment will not be changed without the customer’s agreement.

The customer is responsible for any applicable taxes, transaction fees, or other charges disclosed before payment.

9. Cancellations and Refunds

A customer may cancel a paid review before substantive work begins and receive a refund, less any nonrefundable payment-processing charges where permitted by law.

Once substantive review work has begun, payments are generally nonrefundable because time and professional effort have already been committed. Claimsurance may, at its discretion, provide a partial refund if only part of the agreed work has been completed.

If Claimsurance cannot complete an accepted review, Claimsurance will provide an appropriate refund for any portion of the paid service that was not delivered.

10. Turnaround Times

Any turnaround time displayed on the website or communicated to a customer is an estimate rather than a guarantee.

The estimated completion period begins after Claimsurance has received:

  • All reasonably requested documents
  • The customer’s confirmed scope of review
  • Any required payment
  • Answers to necessary follow-up questions

Delays may result from incomplete information, unusually complex documents, technical problems, illness, emergencies, or circumstances beyond Claimsurance’s reasonable control.

11. Customer Documents

You retain ownership of documents and information you submit.

By submitting materials, you give Claimsurance a limited, nonexclusive permission to access, copy, organize, analyze, and use those materials only as reasonably necessary to evaluate your request, provide the service, maintain business records, protect legal rights, and comply with applicable law.

The collection and handling of personal information are also governed by the Claimsurance Privacy Policy.

Claimsurance cannot guarantee that electronic transmission or storage will be completely secure. You should retain copies of all original documents.

12. Confidentiality

Claimsurance will take reasonable measures to protect nonpublic claim information submitted for review.

However, no website, email service, form provider, payment processor, cloud-storage system, or electronic communication method can guarantee absolute security.

Claimsurance may disclose information when reasonably necessary to:

  • Provide a requested service
  • Work with service providers supporting website or business operations
  • Process payments
  • Comply with law, legal process, or regulatory requirements
  • Protect the rights, safety, property, or security of Claimsurance or others
  • Investigate suspected fraud, misuse, or unlawful activity

Additional information about data practices appears in the Privacy Policy.

13. Prohibited Uses

You may not use Claimsurance.com to:

  • Submit false, deceptive, fraudulent, or unlawfully obtained information
  • Impersonate another person
  • Violate another person’s privacy or intellectual-property rights
  • Upload malicious code or interfere with website operations
  • Attempt to obtain unauthorized access to accounts, systems, or data
  • Misrepresent a Claimsurance report as a legal opinion, engineering report, formal appraisal, insurer decision, or government finding
  • Alter a Claimsurance report in a misleading manner
  • Use the service for an unlawful purpose

Claimsurance may refuse or discontinue service when fraud, misrepresentation, abuse, unlawful conduct, or a conflict of interest is reasonably suspected.

14. Intellectual Property

The Claimsurance name, website design, original written content, report formats, evaluation methods, graphics, and other proprietary materials are owned by Claimsurance or used with permission.

You may use a report prepared for you for your own personal, business, insurance, or legal consultation purposes. You may share it with your insurer, attorney, public adjuster, regulator, or another professional assisting with your matter.

You may not sell, publicly republish, copy for commercial distribution, or create derivative products from Claimsurance materials without prior written permission.

15. Third-Party Services and Links

Claimsurance.com may contain links to third-party websites, referral opportunities, payment processors, form providers, or other services.

Claimsurance does not control and is not responsible for third-party content, availability, security, privacy practices, eligibility decisions, employment decisions, insurance decisions, products, or services.

A link does not necessarily constitute an endorsement. Your use of a third-party service is governed by that provider’s own terms and policies.

Any referral or affiliate relationship will be disclosed where applicable.

16. Disclaimer of Warranties

To the fullest extent permitted by law, Claimsurance.com and its services are provided “as is” and “as available.”

Claimsurance disclaims all warranties, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, noninfringement, continuous availability, and error-free operation.

Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

17. Limitation of Liability

To the fullest extent permitted by law, Claimsurance and its owner, operators, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost insurance proceeds, lost profits, lost data, missed deadlines, or losses resulting from reliance on a report or website content.

To the fullest extent permitted by law, Claimsurance’s total liability arising from a paid service will not exceed the amount the customer paid Claimsurance for the specific service giving rise to the claim.

These limitations do not apply where liability cannot lawfully be limited or excluded.

18. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Claimsurance and its owner, operators, contractors, and service providers from claims, damages, losses, liabilities, and reasonable expenses arising from:

  • Information or documents you submit without authorization
  • Your unlawful or prohibited use of the website or a report
  • Your material violation of these Terms
  • Fraudulent, deceptive, or misleading conduct by you

19. Termination or Refusal of Service

Claimsurance may suspend or terminate access to the website or decline or discontinue a service request when reasonably necessary to protect the website, customers, third parties, or Claimsurance.

If Claimsurance ends a paid assignment without customer fault before completing the agreed service, the customer will receive an appropriate refund for the undelivered portion.

Sections that logically should remain effective after termination—including intellectual-property, disclaimer, liability, and dispute provisions—will survive.

20. Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles.

Any legal proceeding arising from these Terms or the use of Claimsurance.com must be brought in a court of competent jurisdiction in Mobile County, Alabama, unless applicable law requires otherwise.

21. Changes to These Terms

Claimsurance may revise these Terms periodically. Updated Terms will be posted on this page with a new effective date.

Changes apply prospectively from the posted effective date. Your continued use of the website or purchase of services after an update constitutes acceptance of the revised Terms.

22. Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.

23. Entire Agreement

These Terms, the Privacy Policy, the applicable service description, and any written price or scope confirmation constitute the agreement between you and Claimsurance regarding the website and requested services.

If a written service confirmation conflicts with these general Terms, the written service confirmation will control for that particular assignment.

24. Contact

Questions about these Terms and Conditions may be submitted through the contact or claim-review form on Claimsurance.com.
